Welcome to FynCut! These Terms of Service ("Terms") govern your access to and use of our AI-powered video clipping platform. By accessing or using FynCut, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, accessing, or using FynCut's services, you agree to comply with and be bound by these Terms, our Privacy Policy, and all applicable laws and regulations. If you do not agree with these Terms, please do not use our services.

2. Description of Service

FynCut is an AI-powered video clipping platform that helps creators transform long-form content into viral short clips. Our services include:

• AI-powered video transcription and analysis
• Automatic detection of viral moments and highlights
• Active speaker tracking and intelligent video cropping
• GPU-accelerated video rendering and processing
• Credit-based processing system

We reserve the right to modify, suspend, or discontinue any aspect of the service at any time, with or without notice, and without liability to you.

3. User Accounts

3.1 Account Creation

To use FynCut, you must create an account by providing accurate and complete information. You must be at least 13 years old to use our services.

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach
• Ensuring your account information remains accurate and up-to-date

3.3 Account Termination

You may terminate your account at any time through your account settings. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Credit System and Pricing

4.1 Credit Purchase

FynCut operates on a credit-based system where 1 credit = 1 generated clip. New users receive 5 free credits upon sign-up. Additional credits can be purchased in packages:

• Starter Pack: ₹999 for 20 credits
• Creator Pack: ₹2,499 for 60 credits
• Pro Pack: ₹4,999 for 150 credits
• Studio Pack: ₹10,999 for 400 credits

4.2 Credit Usage

Credits are deducted when clips are successfully generated. Failed processing attempts do not consume credits. Credits do not expire and remain valid indefinitely.

4.3 Pricing Changes

We reserve the right to modify our pricing at any time. Existing credit balances purchased before price changes remain unaffected.

5. Payment Terms

All payments are processed securely through Razorpay. By making a purchase, you agree to Razorpay's terms and conditions. Payments are non-refundable except as outlined in our Refund Policy.

6. Content Guidelines and Intellectual Property

6.1 Your Content

You retain all rights to the content you upload to FynCut. By uploading content, you grant us a limited license to:

• Process your videos using our AI tools
• Store your content on our secure servers (AWS S3)
• Generate clips and transcriptions
• Provide the service to you

6.2 Prohibited Content

You agree not to upload, share, or create content that:

• Infringes on intellectual property rights or copyrights
• Contains hate speech, harassment, or discriminatory content
• Promotes violence, illegal activities, or harmful behavior
• Contains malware, viruses, or malicious code
• Violates any applicable laws or regulations
• Impersonates another person or entity
• Contains adult content or material inappropriate for general audiences

6.3 Copyright Compliance

You must have the legal right to upload and process all content. We respect intellectual property rights and will remove content upon receipt of valid DMCA takedown notices.

7. Acceptable Use Policy

You agree not to:

• Use the service for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the service or servers
• Use automated tools to access the service without permission
• Resell or redistribute our services without authorization
• Reverse engineer, decompile, or disassemble any part of the service
• Remove or modify any proprietary notices or labels

8. Service Availability and Limitations

While we strive for high availability, we do not guarantee uninterrupted access to our services. We may experience downtime for maintenance, updates, or unforeseen circumstances. We are not liable for any losses resulting from service interruptions.

9. Data Processing and AI

Our AI models process your content to detect viral moments, transcribe audio, and generate clips. Processing quality may vary based on content quality, audio clarity, and other factors. We do not guarantee specific results or accuracy levels.

10. Limitation of Liability

To the maximum extent permitted by law, FynCut and its affiliates shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Service interruptions or data loss
• Third-party actions or content

Our total liability shall not exceed the amount you paid to FynCut in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless FynCut, its officers, employees, and affiliates from any claims, damages, losses, or expenses arising from:

• Your violation of these Terms
• Your content or use of the service
• Infringement of any intellectual property or other rights

12. Dispute Resolution

These Terms shall be governed by the laws of India. Any disputes shall be resolved through binding arbitration in Bharuch, Gujarat, India, except where prohibited by law.

13. Termination

We reserve the right to terminate or suspend your account immediately, without prior notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Abuse of the service or other users
• Non-payment of fees

Upon termination, your right to use the service ceases immediately. Unused credits are forfeited upon termination for cause but may be refunded for voluntary account closure at our discretion.

14. Changes to Terms

We may update these Terms from time to time. Material changes will be notified via email or platform notification. Your continued use of FynCut after changes constitutes acceptance of the updated Terms.

15. Third-Party Services

Our service integrates with third-party providers (AWS S3, Razorpay, Supabase, Modal). Your use of these services is subject to their respective terms and conditions.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, Refund Policy, and Pricing Policy, constitute the entire agreement between you and FynCut regarding the use of our services.
